1. Introduction and Acceptance
These Terms of Use ("Terms") govern your use of all products and services provided by Detecht Technologies AB ("Detecht", "we", "us"), including the Detecht iOS app, Android app, website (www.detechtapp.com), and any related features (collectively, the "Services").
By downloading, installing, or using the Services, you agree to be legally bound by these Terms and our Privacy Policy. If you do not agree, do not use the Services.
If you are accepting on behalf of an organisation, you confirm that you have the authority to bind that organisation to these Terms.
We will notify you of material changes to these Terms via the app or by email at least 30 days before they take effect. Continued use of the Services after that point constitutes acceptance of the updated Terms.
2. About the Services
Detecht provides a motorcycle companion platform including ride recording, route planning, navigation, crash detection, community features, and related tools. The Services are available on iOS, Android, and web, and are distributed globally through the Apple App Store, Google Play Store, and the Detecht website.
Some features require an active internet connection and GPS access. Certain features, including crash detection, depend on factors outside our control such as your device's condition, battery level, network coverage, and GPS signal. Please do not rely solely on Detecht for safety.
Subscriptions are offered on a free or paid ("Premium") basis. Premium features are described on our website and in the app and may change over time.
3. Eligibility
You may use the Services if you are at least 16 years of age (or the minimum age required by applicable law in your country, whichever is higher), are legally permitted to enter into contracts in your jurisdiction, and have not previously been banned from the Services.
Users between 16 and 18 years of age (or the applicable age of majority in their jurisdiction) may use the Services with the consent and supervision of a parent or legal guardian, who accepts these Terms on their behalf and takes responsibility for their use of the Services, including the crash detection feature.
If we discover that an account is held by someone who does not meet these eligibility requirements, we will close it and delete the associated data.
4. Account Registration and Security
To access most features you must create a Detecht account. When registering, you agree to provide accurate, current, and complete information. You may register using your email address or a supported third-party account such as Google, Apple, or Facebook.
You are responsible for keeping your password and login credentials confidential, for all activity that occurs under your account, and for notifying us immediately at support@detecht.se if you suspect unauthorised access. We reserve the right to suspend or terminate accounts that we reasonably believe have been compromised or are being misused.
5. Subscriptions and Payment
5.1 Free and Premium Plans
Detecht offers a free tier and one or more paid Premium subscription tiers. The features available at each tier are described in the app and on our website and may be updated from time to time.
5.2 Billing and Renewal
Premium subscriptions are available on different billing cycles, such as weekly, monthly, or annual, and the available options may change over time. Fees are charged in advance to your chosen payment method and renew automatically until cancelled. Where subscriptions are purchased through the Apple App Store or Google Play Store, billing is managed by Apple or Google under their respective terms. Subscriptions purchased through our website are managed via Paddle (paddle.com), our authorised reseller and merchant of record, which is responsible for all billing, tax compliance, and refund processing for those transactions.
5.3 Price Changes
We will provide at least 30 days' notice of any price increase before your next renewal date. Continued use of the Services after new pricing takes effect constitutes your acceptance.
5.4 Cancellation
You may cancel your Premium subscription at any time. The primary way to cancel is through the Detecht app via Profile Settings, then Cancel Subscription. You can also cancel by logging in to www.detechtapp.com and navigating to your profile page. Alternatively, you can cancel through your device's native subscription management: iOS Settings for App Store subscriptions, or the Google Play Store under Subscriptions for Android. Web subscriptions purchased through Paddle can be managed via your Paddle billing portal or by contacting support@detecht.se.
Cancellation takes effect at the end of the current billing period. You will retain access to Premium features until then.
5.5 Refunds
App Store and Google Play purchases are subject to Apple's and Google's respective refund policies. Refund requests for those purchases must be made directly through Apple or Google. For web purchases through Paddle, refund requests can be made by contacting us at support@detecht.se, and will be handled in accordance with Paddle's refund policy.
EU and EEA consumers: you have the statutory right to withdraw from a purchase within 14 days of the transaction date. This right is forfeited if you have expressly consented to the service starting immediately and acknowledged that withdrawal is not available once the service has commenced. To exercise the right of withdrawal for a Paddle purchase, contact support@detecht.se.
Australian consumers: our Services come with consumer guarantees under the Australian Consumer Law that cannot be excluded, restricted, or modified.
6. Acceptable Use
You may use the Services only for lawful, personal, non-commercial purposes. You agree not to reverse engineer, decompile, or disassemble the app or any part of the Services, use the Services in a way that could harm other users, third parties, or Detecht, attempt to gain unauthorised access to any system or data, upload viruses or other harmful code, harass or abuse others, commercially exploit or resell the Services without our written permission, or use the Services while riding in a way that endangers yourself or others.
We reserve the right to restrict, suspend, or terminate your access to the Services, with or without notice, if you violate these Terms or applicable law.
7. Crash Detection — Limitations and Liability
Detecht includes a crash detection feature that uses GPS and motion sensor data from your mobile device to attempt to identify potential motorcycle accidents. Please read this section carefully before enabling the feature. Crash detection requires the Detecht app to be running an active ride tracking or navigation session.
7.1 How Crash Detection Works
When the app detects a potential crash event, a countdown notification is displayed on your device. You have 60 seconds to dismiss the notification if no accident has occurred. If the notification is not dismissed within that window, an SMS alert is sent to the emergency contact(s) you have designated in your profile, containing your last known GPS position. The alert is delivered via a third-party SMS provider.
In Sweden, if you have enabled the SOS Alarm integration, a notification may additionally be sent to SOS Alarm at the same time. Crash detection uses a minimum speed threshold of 18 km/h and will not trigger at lower speeds. Due to the nature of processing and transmission, detection may occur up to approximately one minute after the actual crash event.
7.2 Limitations You Must Understand
Crash detection is a technology-based safety feature designed to assist, not to replace, your own safety arrangements. It operates within specific technical parameters and cannot account for every real-world situation. By enabling the feature, you accept the following limitations.
- Missed detections: the feature may fail to detect a real accident. This can occur due to how the device is mounted or carried, the angle or nature of the impact, depleted battery, loss of GPS or mobile network, device damage in the crash, faulty device sensors, or any other variable that affects the device's ability to measure and transmit data. No accident scenario is guaranteed to trigger detection.
- False alarms: the feature may trigger when no crash has occurred, for example during aggressive riding, off-road use, a sudden stop, or the device being dropped. A false alarm may result in an unnecessary alert being sent to your designated emergency contact(s) and, in Sweden, a notification to SOS Alarm. Detecht is not responsible for any false alarm or its consequences, including any emergency resources that may be dispatched as a result.
- Transmission failures: even if a crash is detected and the countdown completes, the SMS alert may fail to be delivered due to lack of mobile network coverage, provider unavailability, or other technical factors outside our control.
- Emergency contact limitations: your designated emergency contact may not receive, read, or be able to act on an alert in time. Detecht has no control over the actions or availability of your emergency contact.
- Sweden only for emergency services: automated crash notifications to an emergency service are available only in Sweden through the SOS Alarm integration. Outside Sweden, crash detection alerts are sent only to the emergency contact you have designated in the app. Detecht does not contact emergency services in any other country.
- Device dependency: crash detection requires your device to be powered on, charged, running an active Detecht tracking or navigation session, and able to transmit data at the time of the event. Detecht has no control over any of these conditions.
- SOS Alarm response (Sweden only): when a potential crash is detected, a notification may be sent to SOS Alarm. SOS Alarm independently decides whether and how to respond to that notification. Detecht has no control over or responsibility for SOS Alarm's actions or decisions following a notification.
7.3 Not a Substitute for Other Safety Measures
Crash detection is a supplementary feature and must not be treated as your primary or sole safety arrangement. Before every ride you should tell someone your planned route and expected return time, carry your own means of communication, ensure your device is charged and has network coverage for the routes you plan to ride, and follow local road traffic laws and wear appropriate protective equipment.
7.4 SOS Alarm Integration (Sweden only)
Detecht offers an optional integration with SOS Alarm, the Swedish national emergency response service. If you activate this feature, a notification may be sent to SOS Alarm when a potential crash is detected, enabling an emergency responder to call you back. Activating this feature requires you to provide a callback phone number in the app.
When a potential crash is detected, a notification may be sent to SOS Alarm. SOS Alarm independently decides whether and how to respond to that notification. Detecht has no control over or responsibility for SOS Alarm's actions or decisions following a notification.
If you lend your device to another person, disable crash detection first. Any triggered alert will use the phone number associated with your account, not the person using the device.
7.5 Limitation of Liability for Crash Detection
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, DETECHT, ITS BOARD MEMBERS, DIRECTORS, EMPLOYEES, AGENTS, AND SUPPLIERS EXPRESSLY DISCLAIM ALL LIABILITY, UNDER ANY LEGAL THEORY INCLUDING NEGLIGENCE, CONTRACT, STRICT LIABILITY, OR TORT, FOR ANY LOSS, INJURY, DEATH, COST, OR DAMAGE OF ANY KIND ARISING FROM OR RELATED TO: THE FAILURE OF CRASH DETECTION TO DETECT AN ACCIDENT; THE FAILURE OF AN ALERT TO BE SENT, DELIVERED, OR ACTED UPON; A FALSE ALARM AND ANY CONSEQUENCES RESULTING FROM IT; RELIANCE ON CRASH DETECTION AS A PRIMARY SAFETY MEASURE; ANY DELAY IN DETECTION, TRANSMISSION, OR RESPONSE; OR THE FEATURE BEING UNAVAILABLE FOR ANY REASON.
THIS LIMITATION APPLIES REGARDLESS OF WHETHER DETECHT WAS ADVISED OF THE POSSIBILITY OF SUCH LOSS OR DAMAGE, AND REGARDLESS OF THE LEGAL THEORY ON WHICH THE CLAIM IS BASED.
Nothing in this section excludes or limits liability for death or personal injury caused by Detecht's gross negligence or wilful misconduct, or any other liability that cannot be excluded or limited under applicable mandatory law.
8. User Content
8.1 Your Content
You may submit content such as routes, ride recordings, hazard reports, comments, and photos ("User Content"). You retain ownership of any intellectual property rights you hold in your User Content.
8.2 Licence to Detecht
By submitting User Content, you grant Detecht a worldwide, royalty-free, non-exclusive, sublicensable licence to use, store, reproduce, modify, adapt, distribute, and display your User Content solely for the purpose of operating, improving, and promoting the Services.
Ride sensor data generated while using the Services, including GPS tracks, motion sensor readings, road condition data, and hazard reports, may be aggregated and anonymised by Detecht. Aggregated data contains no personally identifiable information and may be used for road safety research, service improvement, and may be shared with or sold to third parties such as research organisations, road safety authorities, automotive partners, and other commercial partners. This is consistent with our Privacy Policy (Section 5.4).
8.3 Content Standards
You agree not to submit User Content that is unlawful, defamatory, obscene, or harassing, infringes the intellectual property or privacy rights of others, contains viruses or malicious code, or advertises third-party products or services without our permission. We may remove User Content that violates these standards at our sole discretion, without notice.
9. Intellectual Property
All intellectual property rights in the Services, including the app, website, software, design, trademarks, and content produced by Detecht, belong to Detecht or its licensors. Nothing in these Terms grants you any right to use our intellectual property beyond what is strictly necessary to use the Services.
"Detecht" and the Detecht logo are trademarks of Detecht Technologies AB. You may not use our trademarks without our prior written consent.
10. Third-Party Services
The Services integrate with third-party services and platforms. These third parties operate under their own terms and privacy policies, which you should review before use. Detecht is not responsible for the content, availability, or practices of any third-party service.
If you download the Detecht app from the Apple App Store or Google Play Store, your contract for the app is with Detecht, not Apple or Google. Apple and Google are not parties to these Terms and have no obligation to provide support or maintenance for the Services. However, as a consumer you may be entitled to seek a refund from Apple or Google if the app does not conform to applicable quality standards.
11. Disclaimers
The Services are provided "as is" and "as available". To the fullest extent permitted by applicable law, Detecht disclaims all warranties, express or implied, including warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Services will be uninterrupted or error-free, that any content within the Services constitutes professional advice of any kind, or that features will be available on all devices or in all locations.
Nothing in these Terms limits or excludes any guarantees, warranties, or rights you have under mandatory consumer protection law in your jurisdiction, including the EU Consumer Rights Directive, the Australian Consumer Law, or equivalent legislation.
12. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW: (A) DETECHT IS NOT LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, PUNITIVE, OR CONSEQUENTIAL DAMAGES, INCLUDING LOSS OF DATA, REVENUE, OR PROFIT, ARISING FROM YOUR USE OF THE SERVICES; AND (B) OUR AGGREGATE LIABILITY TO YOU FOR ALL CLAIMS ARISING UNDER THESE TERMS IS LIMITED TO THE GREATER OF THE TOTAL SUBSCRIPTION FEES YOU PAID IN THE 12 MONTHS BEFORE YOUR CLAIM, OR EUR 50.
Nothing in these Terms excludes or limits Detecht's liability for death or personal injury caused by our negligence, fraud or fraudulent misrepresentation, or any liability that cannot be excluded or limited under applicable mandatory law. In jurisdictions where certain limitations are not permitted, our liability is limited to the maximum extent allowed by law.
13. Indemnity
You agree to indemnify and hold harmless Detecht and its board members, directors, employees, and agents from any claims, losses, or expenses (including reasonable legal fees) arising from your breach of these Terms, your User Content, or your violation of any applicable law.
14. Governing Law and Disputes
These Terms are governed by the laws of Sweden. Subject to the mandatory consumer protection laws of your country of residence, any disputes arising from these Terms shall be submitted to the exclusive jurisdiction of the Gothenburg District Court (Göteborgs tingsrätt) as the court of first instance.
EU residents: as a consumer you may also use the European Commission's Online Dispute Resolution platform at https://ec.europa.eu/consumers/odr. We do not currently participate in any alternative dispute resolution scheme.
Australian residents: nothing in these Terms limits your rights under the Australian Consumer Law or your right to contact the Australian Competition and Consumer Commission (ACCC).
15. Changes to These Terms
We may update these Terms from time to time. For material changes, we will give you at least 30 days' advance notice via the app or by email before the changes take effect. This is required under applicable consumer protection law and is not simply a courtesy; you will always have time to review any change and decide whether to continue using the Services. If you do not agree to the revised Terms, you may stop using the Services and cancel your subscription. Continued use after the notice period constitutes acceptance.
16. General Provisions
Severability: if any provision of these Terms is found to be invalid or unenforceable, the remaining provisions will continue in full force and effect.
No waiver: our failure to enforce any right under these Terms does not constitute a waiver of that right.
Assignment: you may not assign your rights under these Terms without our prior written consent. We may assign our rights freely in connection with a merger, acquisition, or sale of assets.
Entire agreement: these Terms and our Privacy Policy constitute the entire agreement between you and Detecht regarding the Services and supersede all prior agreements or understandings.
Language: these Terms are made available in English. In the event of any conflict between translated versions and the English version, the English version prevails.
